Conscience, once a core concept for ethics, has mostly disappeared from modern moral theory. In this book Douglas Langston traces its intellectual history to account for its neglect while arguing for its still vital importance, if correctly understood. In medieval times, Langston shows in Part I, the notions of "conscientia" and "synderesis" from which our contemporary concept of conscience derives were closely connected to Greek ideas about the virtues and practical reason, although in Christianized form. As modified by (...) Luther, Butler, and Kant, however, conscience later came to be regarded as a faculty like will and intellect, and when faculty psychology fell into disrepute, so did the role of conscience in moral philosophy. A view of mature conscience that sees it as relational, with cognitive, emotional, and conative dimensions, can survive the criticisms of conscience as faculty. In Part II, through discussions of Freud, Ryle, and other modern thinkers, Langston proceeds to reconstruct conscience as a viable philosophical concept. Finally, in Part III, this better grounded concept is connected with the modern revival of virtue ethics, and Langston shows how crucial conscience is to a theory of virtue because it is fundamental to the training of any morally good person. The intellectualistic analysis of conscience Aquinas provides appears to regard conscience as mechanistic and undynamic. Such understanding fails to place Aquinas’s remarks on conscience in the context of the virtue ethics he offers in the Summa and his Commentary on the Nicomachean Ethics. In fact, there is an intricate connection between the virtues and conscience in Aquinas’s thought, and this connection relates directly to his remarks on weakness of will. Each essay focuses on a figure or issue in the early modern period and connects the topic to relevant medieval material. So, for example, Risto Saarinen's "Ethics in Luther's Theology: The Three Orders" relates Luther's views of the three estates—church (ecclesia), household (œconomia), state (politia)—to the division medieval Aristotelian ethicists made between Aristotle's individual and social ethics.If one of the strengths of this collection is the range and diversity of material treated, it is also its principal weakness. It is difficult to imagine that most readers will be interested in the essays of all three sections. As the titles of the sections suggest, readers interested in the views of humanists or reformers will look to the essays of the third section primarily. Those who are interested in backgrounds to modern theories about human rights and property will look to the second section. And the first section will appeal to those interested in scholasticism, probabilism, and casuistry. This is not to suggest that the three sections [End Page 475] are unconnected. In fact, there are very strong connections between the first and second sections in showing how certain key notions of modern thought develop in the period from 1400 to 1600. And some of the essays of the third section present the views of certain reformers and humanists on related issues.In the second section, Roberto Lambertini's "Poverty and Power: Franciscans in Later Medieval Political Thought" and Virpi Mäkinen's "The Franciscan Background of Early Modern Rights Discussion: Rights of Property and Subsistence" argue that concepts of individual rights and property—hallmarks of modern thought—emerge in the controversies surrounding Franciscan poverty. Questions about whether property or only its use is natural are connected to issues about individual rights of subsistence, particularly whether Franciscan poverty is against the inalienable natural right of self-preservation everyone possesses. In "Conrad Summenhart on Natural Rights," Jussi Varkemaa shows how Summenhart used Jean Gerson's discussions of jus to argue that a person is dominus (lord) of his own person and can voluntarily enslave himself to another without violating his natural right of liberty. Issues about individual rights are also at play in several essays in the first section of the book. Sven K. Knebel's "Casuistry and the Early Modern Paradigm Shift in the Notion of Charity" discusses how an innocent person is to behave under torture. At issue is whether an innocent should suffer death by maintaining his innocence or preserve his life by sacrificing his reputation through lying. This conflict led to discussions about the status of one's reputation—is it the property of an individual?—as well as the nature of the right of self-preservation. Similarly, Rudolf Schüssler's "On the Anatomy of Probabilism" discusses how the "possidentis principle" became a cornerstone of probabilism at the end of the sixteenth century. A number of theoretical positions in psychology—including variants of case‐based reasoning, instance‐based analogy, and connectionist models—maintain that abstract rules are not involved in human reasoning, or at best play a minor role. Other views hold that the use of abstract rules is a core aspect of human reasoning. We propose eight criteria for determining whether or not people use abstract rules in reasoning, and examine evidence relevant to each criterion for several rule systems. We argue that there is substantial evidence (...) that several different inferential rules, including modus ponens, contractual rules, causal rules, and the law of large numbers, are used in solving everyday problems. The fact that Internet companies may record our personal data and track our online behavior for commercial or political purpose has emphasized aspects related to online privacy. This has also led to the development of search engines that promise no tracking and privacy. Search engines also have a major role in spreading low-quality health information such as that of anti-vaccine websites. This study investigates the relationship between search engines’ approach to privacy and the scientific quality of the information they return. (...) We analyzed the first 30 webpages returned searching “vaccines autism” in English, Spanish, Italian, and French. The results show that not only “alternative” search engines but also other commercial engines often return more anti-vaccine pages (10–53%) than Google (0%). Some localized versions of Google, however, returned more anti-vaccine webpages (up to 10%) than Google. Health information returned by search engines has an impact on public health and, specifically, in the acceptance of vaccines. The issue of information quality when seeking information for making health-related decisions also impact the ethical aspect represented by the right to an informed consent. Our study suggests that designing a search engine that is privacy savvy and avoids issues with filter bubbles that can result from user-tracking is necessary but insufficient; instead, mechanisms should be developed to test search engines from the perspective of information quality (particularly for health-related webpages) before they can be deemed trustworthy providers of public health information. Loss of personal identity in dementia can raise a number of ethical considerations, including the applicability of advance directives and the validity of patient preferences that seem incongruous with a previous history of values. In this chapter, we first endorse the self-concept view as the most appropriate approach to personal continuity in healthcare. We briefly describe two different types of dementia, Alzheimer’s dementia (AD) and behavioral-variant frontotemporal dementia (bv-FTD). We identify elements considered important for the continuation of a self-concept, including (...) continuation of memories, consistency in personality traits and personal preferences, and continued endorsement of certain moral tenets. We show that, depending on which element is considered most important for personal identity, continuity of a self-concept for individuals with distinct types of dementia will be affected and assessed differently. Utilizing a variety of empirical evidence, we argue that persistence of memory, personality traits, and preferences are not the most important for the maintenance of personal identity. Instead, as studies aimed to capture the folk-psychological view of personal continuity demonstrate, judgements about continuity depend primarily on the persistent commitment to widely shared moral beliefs. Because of that, we argue that individuals with bv-FTD are more likely to lose their sense of self than individuals whose dementia primarily affects memory, such as Alzheimer’s disease. We end the chapter by showing how the importance of moral beliefs for continuity of self can be used to provide guidance to health-care professionals when considering changes in preference by individuals with dementia. The authors present a case study involving truth telling responsibilities in the setting of nonepileptic seizures. Specifically, over the course of several suspected nonepileptic seizures, a patient’s seizures stopped after he received a saline flush meant to precede the administration of anti-seizure medication. The patient and his surrogate believed he had received the medication each time, and the team wondered whether they should disclose the truth. Some worried that disclosure would reinforce the suspected psychogenic behavior, exacerbating the patient’s condition. In (...) this way, the case study presents a twist on the traditional truth telling archetype. While most truth telling cases center on navigating cultural differences or worries about emotional harm, this case presented concerns about medical harm in the form of exacerbating the patient’s condition. The authors describe the complex patient-family-team dynamic that preceded this ethical dilemma, describe the case, analyze the ethical issue, and describe the outcome. (shrink)

This paper proposes that billing gamesmanship occurs when physicians free-ride on the billing practices of other physicians. Gamesmanship is non-universalizable and does not exercise a competitive advantage; consequently, it distorts prices and allocates resources inefficiently. This explains why gamesmanship is wrong. This explanation differs from the recent proposal of Heath (2020. Ethical issues in physician billing under fee-for-service plans. J. Med. Philos. 45(1):86–104) that gamesmanship is wrong because of specific features of health care and of health insurance. These features are (...) aggravating factors but do not explain gamesmanship’s primary wrong-making feature, which is to cause diffuse harm not traceable to any particular patient or insurer. This conclusion has important consequences for how medical schools and professional organizations encourage integrity in billing. To avoid free-riding, physicians should ask themselves, “could all physicians bill this way?” and if not, “does the patient benefit from the distinctive service I am providing under this code?” If both answers are “no,” physicians should refrain from the billing practice in question. The problem of evil has traditionally been formulated as a claim about the incompatibility of the statements ‘God exists’ and ‘There occur instances of suffering’. Hume, for example, in his Dialogues Concerning Natural Religion , part x, claims that the statements ‘God exists’ and ‘There occur instances of suffering’ are incompatible. In his esssy ‘Hume on Evil’, Nelson Pike argues that it has not been shown that the statements ‘God exists’ and ‘There occur instances of suffering’ are incompatible because it (...) has not been shown that God could not have a morally sufficient reason for permitting suffering he could prevent. 1 Moreover, according to Pike, the theist who is convinced that God must have a morally sufficient reason for permitting suffering he can prevent will claim that the statements ‘God exists’ and ‘There occur instances of suffering’ are not incompatible. He will claim this even though he cannot specify the morally sufficient reason why God permits suffering he can prevent. The theist will thus maintain that God exists even given the occurrence of suffering in the world. 2 Robert Richman, in his essay ‘The Argument from Evil’, argues that Pike is too generous to the theist. According to Richman, only if the theist can specify the morally sufficient reason why God permits suffering he can prevent will the theist be rationally justified in maintaining that God exists in the face of suffering in the world. Richman supports his position by reformulating the argument from evil in terms of what he calls ‘the logic of our moral judgmentsr’. 3 Richman thinks that his formulation of the argument from evil is successful against the theist who cannot specify the morally sufficient reason why God permits evil he can prevent. In this paper, I shall argue that Richman's argument is not successful against the typical theist, i.e. the person who accepts the existence of God on the basis of faith or a priori arguments. 4. Both Carnap and Quine made significant contributions to the philosophy of mathematics despite their diversedviews. Carnap endorsed the dichotomy between analytic and synthetic knowledge and classified certainmathematical questions as internal questions appealing to logic and convention. On the contrary, Quine wasopposed to the analytic-synthetic distinction and promoted a holistic view of scientific inquiry. The purpose of thispaper is to argue that in light of the recent advancement of experimental mathematics such as Monte Carlosimulations, limiting mathematical inquiry to the domain of (...) logic is unjustified. Robustness studies implemented inMonte Carlo Studies demonstrate that mathematics is on par with other experimental-based sciences. (shrink)
